This Intellehub Privacy policy (“Privacy Policy”) applies to how we collect, use and process your personal information and, in some instances, special personal information. Please read this privacy policy carefully.

Intellehub ("IH", "we", "us" or "our") operates as an ICT company based at Building 30, Oxford Office Park, 3 Bauhinia Street, Highveld Technopark, Centurion, 0169. IH is the responsible party, or data controller in some jurisdictions, in respect of your Personal Information as defined in clause 4. and Special Personal Information as defined in clause 5. This means IH determines the purpose of and means for processing your Personal Information. We are committed to protecting and respecting your privacy.We aim to ensure that our processing of Personal Information is lawful, reasonable and relevant to our business activities, with the objective of improving our services and your experience.

1.2 Information Officer

1.3 Application of this Privacy Policy

This Privacy Policy explains how we process your Personal Information, whether provided by you or collected through other lawful means, when you:

This Privacy Policy must be read together with IH’s Website Terms of Use(the “Terms”) and any other agreements between you and IH(the “Agreements”) This Privacy Policy supplements, but does not replace, the Terms and Agreements. In the event of any conflict or inconsistency, the following order of priority applies:

• the Terms
• any Agreements

We may collect, record, organise, store, update, retrieve, use, share or delete your Personal Information as described in this Privacy Policy. These actions constitute “processing” under POPIA. If you do not agree with this Privacy Policy, you must not engage with us, use the Website, or use our products or services.
Where permitted or required by law, we may process Personal Information without your consent, provided a lawful justification exists under POPIA.

This Privacy Policy applies to the processing of Personal Information relating to users of our Website, clients, suppliers, service providers, job applicants, employees, former employees and other persons who engage with us, regardless of the device used to access the Website (“Access Device”). This Privacy Policy does not apply to third- party websites, applications, products or services that are linked to or advertised on the Website.

Personal Information may be stored on IH systems or those of authorised service providers. Where Personal Information is transferred outside South Africa, we ensure adequate protection through contractual and organisational safeguards as required by POPIA.

We implement reasonable technical and organisational security measures to protect Personal Information.
You acknowledge that no system is completely secure, and to the maximum extent permitted by law, IH is not liable for unauthorised access beyond its reasonable control.

We retain Personal Information only for as long as necessary to fulfil lawful purposes or as required by South African law.

You must notify us if your Personal Information changes. We will take reasonable steps to ensure accuracy and completeness.

The Website and our products or services are not directed at children under the age of 18. We may, in limited instances, process Personal Information of children, for example when providing services to you. In such cases, the processing is done with the consent of a competent person or to comply with a legal obligation. We will not knowingly collect Personal Information from children without such consent or a legal requirement. IH may send you marketing via electronic communication if you've opted-in or are an existing client, in compliance with applicable laws. Subscribing on the Website constitutes consent to receive marketing communications for the purpose of direct marketing (“direct marketing communication”). You may refuse, discontinue, or block any direct marketing communications from us.

This Privacy Policy does not apply to the websites of any other parties, or the applications, products or services such websites advertise and which may be linked to our Website, or websites that link to or advertise on our Website. We are not responsible for the privacy practices of such third party websites, or for any claims, loss or damage arising from these. We advise you to read the privacy policy of each third party website and decide whether you agree to their privacy practices and policies, as these third party websites may also be collecting or sharing your Personal Information and Special Personal Information.

If this Privacy Policy or any provision in this Privacy Policy is regulated by or subject to the Consumer Protection Act, 68 of 2008, the Protection of Personal Information Act, 4 of 2013 (“POPIA”) or other laws, it is not intended that any provision of this Privacy Policy contravenes any provision of the Consumer Protection Act, POPIA or such other laws. Therefore, all provisions of this Privacy Policy must be treated as being qualified, to the extent necessary, to ensure that the provisions of the Consumer Protection Act, POPIA and such other laws are complied with.

No provision of this Privacy Policy:

• does or purports to limit or exempt us from any liability (including, without limitation, for any loss directly or indirectly attributable to our gross negligence or willful default or that of any other person acting for or controlled by us) to the extent that the law does not allow such a limitation or exemption;
• requires you to assume risk or liability for the kind of liability or loss, to the extent that the law does not allow such an assumption of risk or liability; or
• limits or excludes any warranties or obligations which are implied into this Privacy Policy by the Consumer Protection Act (to the extent applicable), POPIA (to the extent applicable), or other applicable laws or which we give under the Consumer Protection Act (to the extent applicable), POPIA (to the extent applicable), or other applicable laws, to the extent that the law does not allow them to be limited or excluded.

This Privacy Policy is governed by South African law. We may transfer, assign, or subcontract our rights and obligations under this policy (including to service providers or business acquirers) without your permission or notice, except where legally required. This policy binds our successors and assigns. Our failure to enforce any provision does not waive our rights. If any provision is found invalid or unenforceable, it will be severed while the remainder of this policy remains in full effect.
